1. About these Terms
These Terms of Service (“Terms”) govern your use of the DZEN PADEL online store and purchases made through it. By accessing the store or placing an order, you agree to these Terms. If you do not agree, you should not use the store or place an order.
Nothing in these Terms limits or excludes any mandatory rights that apply to you under consumer law. If a provision conflicts with a mandatory legal right, that legal right prevails.

The store is hosted by Shopify. Purchases made through the store are contracts between you and DZEN PADEL, not Shopify.
3. Eligibility and customer accounts
You must have the legal capacity to enter into a contract. If you are under the age at which you can contract independently in your country, a parent or legal guardian must place or authorise the order.
If you create a customer account, you must provide accurate information and keep your login details secure. You are responsible for activity carried out through your account unless it results from circumstances for which you are not legally responsible. Please notify us promptly if you believe your account has been used without authorisation.
4. Products and availability
We aim to describe and display products accurately. Product images are illustrative, and colours may vary slightly depending on the screen or device. This does not affect your rights where a product does not conform to its description, sample, advertised qualities or the contract.
All products are subject to availability. Stock information can occasionally be incorrect because of simultaneous orders or technical delays. If a product becomes unavailable after you order, we will inform you and refund any amount paid for that product without undue delay.
We may update product information, prices and availability before an order is accepted. Changes will not affect an order that we have already accepted, except where required by law or expressly agreed with you.
5. Prices, taxes and additional charges
The price shown on the product page and at checkout is the price applicable when you place the order, subject to correction of an obvious error before acceptance. The checkout will show the total price, applicable taxes, delivery charges and any other charges before you submit the order.
You will not be charged optional or additional costs that were not disclosed before purchase and expressly accepted where consent is required.
For deliveries outside the European Union, import duties, taxes or customs charges may apply. Where these amounts are not collected at checkout, they may be payable by the recipient to the relevant authority or carrier. Available delivery destinations and charges are shown at checkout.
6. Placing an order and formation of the contract
Before submitting an order, you can review the products, quantities, delivery details and total price and correct errors. By selecting the final purchase button, you make an offer to buy the products in your order and authorise the applicable payment.
After you place an order, we will send an electronic confirmation. The sales contract is formed when we send confirmation that we have accepted the order. We will provide the contractual information in a durable electronic format, normally by email.
We may refuse or cancel an order before acceptance where reasonably necessary, including because a product is unavailable, payment is not authorised, delivery is not possible, an obvious pricing or description error occurred, we reasonably suspect fraud or misuse, or the order would breach applicable law. If payment has been taken for an order we do not accept, we will refund it without undue delay.
Please contact us promptly if you notice an error after ordering. Whether an accepted order can be changed or cancelled depends on its processing status and your applicable statutory or contractual cancellation rights.
7. Payment
Available payment methods are displayed at checkout. Payments are processed by Shopify and the selected payment provider. You must be authorised to use the payment method and provide accurate billing information.
We may carry out or rely on payment-security and fraud-prevention checks. If payment cannot be authorised, the order may not be accepted or may be cancelled, and we will inform you where appropriate.
8. Delivery and transfer of risk
Delivery options, estimated times and charges are displayed at checkout or described in our Shipping Policy. Delivery dates are estimates unless we expressly agree that a date is guaranteed.
For consumers in the European Union, unless a different delivery period has been agreed, goods will be delivered without undue delay and normally no later than 30 days after the contract is concluded. If delivery is late, you have the remedies provided by applicable law, which may include setting an additional reasonable period and then terminating the contract and receiving a refund.
Where we arrange the carrier, the risk of loss or damage remains with us until you, or a person designated by you other than the carrier, takes physical possession of the goods. If you independently choose and commission a carrier that we did not offer, risk may pass when the goods are delivered to that carrier, as permitted by law.
You are responsible for providing a complete and accurate delivery address and for reasonably cooperating with delivery. Additional costs caused by an incorrect address or an unjustified failure to accept delivery may be charged only where permitted by law and reasonably incurred.
9. Cancellation, withdrawal, returns and refunds
Our Refund Policy explains how to cancel an eligible purchase, return products and request a refund. It forms part of these Terms.
Consumers in the European Union generally have a statutory right to withdraw from an eligible distance purchase within 14 calendar days after receiving the goods, without giving a reason, subject to legal exceptions. DZEN PADEL also offers the additional voluntary return period described in the Refund Policy.
Contractual return conditions do not restrict rights relating to defective, damaged, incorrect or non-conforming products, or any other mandatory consumer rights.
10. Legal guarantee and non-conforming goods
Products must conform to the contract and to the description and qualities reasonably expected under applicable law. If goods are defective or non-conforming, please contact us at bqks1980@gmail.com with the order number and a description of the issue.
Consumers may be entitled to remedies such as repair, replacement, a price reduction or termination of the contract and a refund, subject to the order and conditions established by applicable law. Statutory remedies are provided without charge where required by law.
For new goods delivered to consumers in Spain, the statutory conformity period is generally three years from delivery. Consumers in other countries retain any longer or additional protection provided by the mandatory law applicable to them. A manufacturer's or other commercial warranty is additional to, and does not replace or reduce, the statutory legal guarantee.
11. Promotions, discount codes and gift cards
Promotions and discount codes are subject to the conditions stated with the offer, including validity dates, eligible products and any reasonable usage limits. Unless stated otherwise, promotions cannot be combined. A promotion will not reduce statutory rights or the legal guarantee.
Gift cards, if offered, are subject to the conditions shown when purchased or issued and to applicable law.
12. Acceptable use of the store
You may use the store only for lawful purposes. You must not:
- use the store to commit fraud, violate law or infringe another person's rights;
- introduce malicious code, interfere with security or attempt unauthorised access;
- use automated means to overload, disrupt or extract data from the store in a manner that violates applicable law or our rights;
- submit false, misleading, abusive or unlawful content; or
- use the store in a way that materially interferes with another person's use.
Reasonable access by search engines, accessibility tools and other services that respect applicable technical instructions and law is not prohibited by this section.
13. Intellectual property
The store's design, text, graphics, logos, photographs, videos and other content are owned by or licensed to DZEN PADEL or the relevant rights holder and are protected by intellectual-property law.
You may access and make reasonable copies of store content for personal, non-commercial shopping purposes. You may not reproduce, distribute, modify, publish, commercially exploit or otherwise use protected content without permission, except where applicable law permits it.
14. Reviews and other content you submit
If the store allows you to submit a review or other content, you must have the right to provide it and it must be honest, relevant and lawful. It must not contain unlawful, infringing, deceptive, abusive or malicious material or another person's personal data without authority.
You retain ownership of your content. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display and adapt that content only as reasonably necessary to operate, moderate and promote the store and products. This licence ends when the content is deleted, except for copies already lawfully used or retained where required by law.
We may moderate or remove content where reasonably necessary to comply with law, protect rights or enforce these Terms.
15. Third-party services and links
The store may contain links to, or integrations with, services operated by third parties. We do not control independent third-party services, and their own terms and privacy notices apply. We are not responsible for third-party content or services except to the extent that liability cannot lawfully be excluded.
16. Store availability
We aim to keep the store accurate, secure and available, but temporary interruptions may occur because of maintenance, technical faults, security incidents or events outside our reasonable control. We may modify or discontinue store features, but this will not affect orders already accepted or mandatory rights.
17. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, intentional misconduct, or breach of mandatory consumer rights.
For consumers, we are responsible for losses that are a reasonably foreseeable result of our breach of these Terms or failure to use reasonable care. We are not responsible for losses that were not reasonably foreseeable, were caused by information or actions for which you are responsible, or relate to business or commercial activity where the purchase was made wholly for personal use, except where applicable law provides otherwise.
Shopify provides the technology used to host and operate the store but is not the seller of products purchased from DZEN PADEL. This does not affect any rights you may have directly against Shopify in relation to services for which Shopify is legally responsible.
18. Events outside reasonable control
We are not responsible for delay or failure caused by an event outside our reasonable control, provided we take reasonable steps to reduce the effect and resume performance. We will inform affected customers where appropriate. This section does not remove statutory rights relating to delayed or failed delivery, including any right to terminate and receive a refund.
19. Privacy
Our collection and use of personal data are described in our Privacy Policy. Please read it before using the store or placing an order.
20. Suspension and termination
We may restrict or suspend access to an account where reasonably necessary to protect the store, customers or third parties, investigate suspected fraud or security issues, or comply with law. Where appropriate, we will explain the reason and provide a reasonable opportunity to respond. Suspension does not affect rights or obligations relating to an accepted order unless the order is lawfully cancelled.
You may stop using the store at any time and may request closure of your account, subject to retention required for orders, legal obligations and claims as described in the Privacy Policy.
21. Changes to these Terms
We may update these Terms to reflect changes in law, the store or our business practices. The version published when an order is accepted will normally govern that order. Later changes will not retrospectively reduce your rights under an existing contract unless required by law or agreed with you.
22. Governing law and jurisdiction
These Terms and contracts with DZEN PADEL are governed by Spanish law. If you are a consumer, this choice does not deprive you of mandatory protections available under the law of your country of residence.
Courts will have jurisdiction as determined by applicable law. Consumers may bring proceedings in the courts available to them under mandatory consumer and procedural rules; these Terms do not require a consumer to litigate exclusively in Alicante.
23. Complaints and dispute resolution
If you have a complaint, please email bqks1980@gmail.com with your order number and a clear description of the issue. We will try to resolve complaints directly and within a reasonable time.
If a consumer dispute cannot be resolved directly, you may contact the competent consumer authority or an eligible alternative dispute resolution body. The European Commission publishes a list of consumer dispute resolution bodies. We will participate in an alternative dispute resolution procedure where required by law or where we agree to do so.
24. General provisions
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in effect. A failure or delay in enforcing a right is not a waiver of that right. We may transfer our rights or obligations only in a way that does not reduce consumer protections; you may transfer your rights where applicable law permits.
